Diversion Information

The City of Valley Falls offers a Traffic Diversion Program for eligible traffic offenses. Diversion is a privilege, not a right, and approval is determined by the City of Valley Falls Prosecuting Attorney’s Office based on the circumstances of each case.

You are not required to have an attorney to apply for traffic diversion.

About the Diversion Program

If approved, the diversion period is six (6) months. The diversion period begins after you have been approved, the required diversion paperwork and fees have been received, and the appropriate documents have been filed with the Court.

During the six-month diversion period, you cannot be convicted of any moving violations.

If you successfully enter the Diversion Program, you will pay the costs and fees required under your Diversion Agreement rather than the fine shown on the back of your traffic citation.

Diversion fees are based on the underlying charge and location of the offense. For speeding tickets issued along K-16 Highway, the minimum diversion fee is $250, in addition to any other required costs. The diversion fee may be increased depending on the speed alleged in the citation.

Eligibility

The City Prosecuting Attorney’s Office considers several factors when determining whether diversion is appropriate. Diversion is generally presumed not appropriate when:

  • The applicant has a prior criminal or traffic record, including convictions, prior diversions, or pending criminal matters not included in the application.
  • The applicant has had another moving violation during the 12 months preceding the current ticket.
  • The ticket resulted from an accident involving another person or there is an indication that alcohol contributed to the offense.
  • The violation occurred in a construction or school zone or involved a school bus or emergency vehicle.
  • The charge is Driving While Suspended and the underlying suspension resulted from an alcohol-related offense.
  • The applicant is otherwise ineligible based on commercial driver's license requirements.

CDL Notice: An applicant who held a commercial driver's license (CDL) at the time of the offense is ineligible for traffic diversion under federal and Kansas law, whether the applicant was operating a commercial or personal vehicle.

How to Apply

Complete the Traffic Diversion Application in its entirety and submit it with all required documentation.

Your application must include:

  • A completed and signed Traffic Diversion Application.
  • A copy of the front and back of your traffic ticket.
  • A certified copy of your driving record if you have an out-of-state driver's license.
  • Proof of valid insurance if you were charged with failure to show proof of insurance.
  • Proof of driver's license reinstatement if you were charged with Driving While Suspended or a similar offense.

After You Apply

If your application is approved, you or your attorney will receive a Diversion Agreement and Stay of Proceedings. The paperwork will identify the applicable court costs, diversion fees, and any applicable attorney fees.

You must sign and return the required paperwork and submit full payment to the City of Valley Falls Municipal Court Clerk's Office by the deadline provided with your diversion paperwork.

Important Court Appearance Notice

Submitting a diversion application does not excuse you from your scheduled court appearance.

Unless you have received formal notice from the City Prosecutor that your diversion application has been approved, you must appear in Valley Falls Municipal Court on the date and time listed on your Uniform Notice to Appear and Complaint.

Failure to appear may result in suspension of your driver's license and/or the issuance of a bench warrant.
